The officers advise him that they suspect him of trespassing, although no trespassing charge was later filed against him. He screams at the officers, "Am I under arrest?" When he is told he is, he asks, "for what?" "What am I being detained for?"

Buress again asks "what am I being detained for?" 'You don't have probable cause for anything and you're hella stupid right now'.

After one cop accuses him of being hard, Buress can be heard laughing and declaring, "He's just salty because I roasted his ass". "He's just salty because I roasted his ass. I'm not getting in your auto". Additionally, the actor refused to enter the police auto on his own volition, so the officials had to force him inside.

Buress was arrested around 10:30 p.m. Saturday night in the neighborhood of Wynwood, which is now hosting events related to the global art festival Art Basel. "They used to regularly release a-forms on weekends", the reporter, David Ovalle, wrote on Twitter. When the officer declined, Buress became "angry and belligerent". The officer went inside to get Buress because he felt the comedian was too drunk to stay around.
