However the court concluded that video game characters that the actress said were based on her did not resemble her.

In the game, Jonas is famous for her high school movies and is described as "very image-conscious".

Neither Ms Lohan nor Rockstar's owner, Take-Two Interactive, has commented following the latest ruling.

Lindsay Lohan kicked off a lawsuit against the game developer for not only using her likeness for the cartoons, but also for creating another character, Lacey Jonas, which she said was similar to her life.

Six judges at the Court of Appeals in the state of NY unanimously rejected Lohan's claim that a character in GTA V named Lacey Jonas was based on her.

But on Thursday, New York's top court ruled that the characters didn't actually look like her. She tried to push the issue again in the Court of Appeals, who just shared their thoughts recently: "We conclude a computer generated image may constitute a portrait within the meaning of that law".

The judge ruled that the satirical representations of "a modern, beach-going" young woman are not enough to link with Lohan.

The lawsuit was pushed forward in March 2016 despite Take-Two's attempts to get it thrown out as a trial judge sided with Lohan's legal team and wanted to hear what they had to say. The official lawsuit claimed that Lacy Jonas is an "unequivocal" reference to Lohan. It is undisputed that defendants did not refer to plaintiff in GTAV, did not use her name in GTAV, and did not use a photograph of her in that game.

Despite the dismissal of Lohan's appeal, the case may have some lasting ramifications.

Mob Wives star Karen Gravano was also part of the lawsuit over similarities of another character, but the court also rejected her claim, too.
